Who we are and agreeing to these terms

Boddy is operated by Nurlan Gasimov (“Boddy,” “we,” “us”). These terms cover the Boddy iOS app, yourboddy.com, and related services (together, the “Service”).

By creating an account, starting a subscription, or otherwise using the Service, you agree to these terms, Apple’s Standard Licensed Application End User License Agreement, and our Privacy Policy, which explains how we handle personal information. If you do not agree, do not use the Service.

Eligibility and younger users

You must be at least 13 years old to use Boddy. If you are under 18, or under the age of majority where you live, a parent or legal guardian must review and agree to these terms for you. In the European Economic Area and the United Kingdom, if you are below the age at which you can consent to data processing in your country (up to 16), you may use Boddy only with a parent’s or guardian’s consent.

If you are under 18, check with a parent, guardian, or doctor before following calorie targets or weight-loss goals.

Health and safety

Boddy provides general fitness and nutrition information. It is not medical advice, diagnosis, or treatment, and it is not a medical device. It does not replace a physician, registered dietitian, physical therapist, or qualified trainer.

Talk to a doctor before starting a new exercise or nutrition program, especially if you are pregnant or postpartum, have a heart, blood-pressure, or other medical condition, are recovering from an injury or surgery, take medication, or have a history of disordered eating. Calorie, macro, and weight targets are estimates, not prescriptions.

Exercise carries an inherent risk of injury. You decide whether an exercise is right for you. Train within your ability, use safe equipment and a clear space, and stop immediately if you feel pain, dizziness, shortness of breath, or illness. Boddy cannot help in an emergency; if you have one, call your local emergency number.

AI features and accuracy

Form coaching, rep counting, meal recognition from photos and speech, nutrition estimates, workout plans, and coach chat rely on automated systems, including on-device models and third-party AI providers. They can be wrong: a rep can be miscounted, a form cue may not suit your body, a food can be misidentified, and a nutrition value can be off. Review results before relying on them.

Do not rely on Boddy to detect allergens or ingredients you must avoid. Check the packaging or ask whoever prepared the food. Coach answers are generated automatically; they do not come from a human trainer or clinician.

Your account

You are responsible for giving accurate information, keeping your sign-in credentials and device secure, and the activity under your account. If you think someone has accessed your account without permission, email support@yourboddy.com.

You can delete your account at any time from Profile in the app. Deleting your account does not cancel an App Store subscription; cancel it in your Apple Account settings.

Subscriptions, trials, and refunds

Boddy may offer monthly and yearly auto-renewable subscriptions. A seven-day free trial may be available for the yearly plan when displayed by the App Store. The exact localized price and trial eligibility appear before purchase.

Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends. A subscription renews automatically for the same length unless you turn off auto-renew in your Apple Account settings at least 24 hours before the current period ends. Any unused part of a free trial ends when you buy a subscription. You can restore eligible purchases from the subscription screen.

Apple handles billing, cancellations, and refunds under its own policies. You can request a refund at reportaproblem.apple.com. Price changes are communicated to you by Apple as the App Store requires.

License and acceptable use

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Boddy app on Apple devices you own or control, as permitted by the App Store Usage Rules, for your own non-commercial use. You may not:

• copy, modify, distribute, sell, or sublicense the Service or access to it;
• reverse engineer, decompile, or try to extract source code or models, except where the law allows it;
• get around subscription checks, usage limits, or security features;
• access our servers, proxy, or AI features other than through the app, including with bots or scrapers, or use them to build a competing product;
• upload content that is unlawful or infringing, or that you do not have the right to use;
• interfere with, overload, or try to gain unauthorized access to the Service.

Your content

You keep ownership of what you put into Boddy, such as logs, meals, photos, voice samples, and coach-chat messages (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, and display Your Content only as needed to operate, secure, and improve the Service as described in our Privacy Policy, including sending it to the service providers that power the features you use. This license ends when Your Content is deleted from our systems, except for copies we must keep by law or that remain in backups for a limited time.

Custom coach voices: use only a recording of your own voice or of someone who has clearly agreed to it. Do not use custom voices to impersonate, deceive, or harass anyone.

If you send us feedback or suggestions, we may use them without owing you anything. Please do not send feedback you consider confidential.

Shape Boddy posts and comments are visible to others as soon as you post them. Do not include someone else's personal information, abusive material, spam, or content you do not have the right to share. You can delete your posts and comments; we may hide or remove content and restrict accounts that misuse the board. Screenshots are visible to others only when you choose to share them.

Third-party services and nutrition data

Some nutrition results are provided through FatSecret and Open Food Facts. When you use those results, the applicable provider terms and database licenses also apply. Boddy displays the source alongside provider-derived content. See the Data Sources & Attributions page, the FatSecret Platform terms, and the Open Database License.

Apple Health, Sign in with Apple, Google sign-in, and other services you choose to connect are governed by their own terms and privacy policies. We are not responsible for third-party services.

Our intellectual property

The Boddy app, branding, interfaces, exercise demonstrations, and original content belong to Boddy or its licensors and are protected by intellectual-property laws. These terms give you no rights in them beyond the license above. Third-party content remains subject to its owner’s terms.

Changes to the Service and these terms

Features may change, be interrupted, or be discontinued as Boddy develops. We may update these terms. If a change is material, we will tell you in the app or by email before it takes effect. If you keep using the Service after that, the updated terms apply. If you do not agree, stop using the Service and cancel your subscription.

Suspension and termination

You can stop using Boddy at any time. We may suspend or end your access if you materially breach these terms, if the law requires it, or to protect the Service or other people. Where reasonable, we will tell you first. If we shut the Service down entirely, we will give you reasonable advance notice. Sections that by their nature should continue after termination (including Your Content, disclaimers, limitation of liability, and governing law) will continue.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY RECOMMENDATION, RECOGNITION RESULT, REP COUNT, OR FORM CUE WILL BE ACCURATE OR SUITABLE FOR YOU.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) BODDY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF US$50 OR THE AMOUNT YOU PAID FOR BODDY IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or for anything else that cannot be limited under applicable law. If you live somewhere whose consumer laws give you rights these terms cannot override, such as the European Economic Area or the United Kingdom, those rights are not affected.

To the extent permitted by law, you agree to indemnify Boddy against third-party claims, and reasonable costs, arising from your violation of these terms or from Your Content infringing someone else’s rights.

Apple App Store terms

If you downloaded Boddy from the App Store, you and we also agree that:

• These terms are between you and Boddy, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• Boddy, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer-protection and privacy claims, and claims that the app infringes a third party’s intellectual property.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

Governing law and disputes

If you have a problem with Boddy, email support@yourboddy.com first so we can try to resolve it informally. Most issues can be fixed that way.

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally will be decided exclusively by the state or federal courts located in Delaware, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court. If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts where those laws allow it.

California consumer notice

Under California Civil Code Section 1789.3, California users are entitled to this notice: the Service is provided by Nurlan Gasimov, Garabagh Str. 72a, Baku, Azerbaijan. To file a complaint or get more information, write to that address or email support@yourboddy.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.

General

You agree that we may send notices electronically, in the app or by email, and that they satisfy any requirement for written notice. We may transfer these terms as part of a merger, acquisition, or sale of assets, including to a company formed to operate Boddy; you may not transfer them without our consent. These terms, the Privacy Policy, and Apple’s Standard EULA are the entire agreement between you and us about the Service. If a provision is found unenforceable, it will be limited to the minimum extent necessary and the rest stays in effect. Not enforcing a provision is not a waiver of it. You agree to comply with U.S. and other applicable export laws when using the Service.
